How to get out of your mobile phone contract

Are you stuck in a two-year mobile phone contract and desperately want to break it?

Buying a mobile phone on a contract is the most popular option when it comes to getting a new phone in Australia. By signing a 24-month contract, you usually pay nothing up front and receive a brand new mobile. It sounds great, but what if you're stuck in the middle of a contract and you want a new phone?

Before signing any mobile phone contract, you should note that a contract is a legal agreement, so it is wise to check the full terms and conditions of the paper you are signing. You need to understand both your rights and obligations before agreeing to a contract. Even with this in mind, is it possible to break a mobile phone contract?

Option one: I want a new phone but I'm still under contract

If you don't have any issues with your service, then there aren't many options aside from paying the contract cancellation fee. However, it is definitely worth a try to call your provider and let them know you want to upgrade your phone. If you are at least 12 months into your contract, you may be able to upgrade by signing a new contract and therefore getting a new phone without any cost. If you are less than 12 months into your contract, then you will usually be charged a fee on top of your existing plan per month for any upgrade. If you just want to flat out cancel your contract, then you are liable for any cancellation fees you agreed to when you signed the contract; these fees are usually expensive.

Another option is to sell your phone on eBay and with that money (and perhaps a little more) just buy your preferred phone outright. Most mobile phone shops sell phones outright, while there a number of online stores that import the latest mobile phones before they are even released in Australia. A great example is online store MobiCity, which sells all phones unlocked with a 12-month warranty and repair service.

Option two: I want to cancel my contract and change providers because of poor service

Recently, both Optus and Vodafone customers have been dogged by reception issues, including dropped calls, poor service coverage and slow mobile Internet speeds. If you've signed a 24-month mobile phone contract but are suffering poor quality coverage at home or work, you may be in an area known as a "black spot". Technically, reception issues aren't always valid grounds for breaking a contract, but it is definitely worth discussing any issues you're having with your provider.

It pays to be persistent and firm, but at the same time you need to ensure you remain calm and courteous. Shouting and insulting customer service representatives will most likely not get you anywhere. Another option is to try to bargain with your new telco to cover the cost of breaking your contract; often a new telco may be generous if you are promising to switch your business.

If you try these methods and they are unsuccessful, you should then contact the Telecommunications Industry Ombudsman (TIO). The TIO is a free and independent service for residential and small business customers in Australia that can help you resolve complaints about phone problems. Remember that you first must attempt to resolve any issues with your service provider before making a complaint with the TIO.

I am sticking to an old mobile plan with three that doesn't require minimum monthly spend and has 500 free mins to other three mobile. It works out well most of the time as I am not a heavy caller nor texter. However, I do get the occasional 'spike' in bills calling friends on other network, due to the more expensive call rates. Recently I signed up with Amaysim, a budget mobile plan that uses the Optus network and all issues are solved. I still keep my three mobile and use it to call friends on the same network. Whereas Amaysim is used to call ppl from other network or occasional international sms. Best of all, Amaysim let you choose/customise your own mobile number. How sweet!

I lodged a complaint with TIO and received a response from Vodafone within 2 weeks agreeing to waive the rest of my contract (almost 22 months).
I know of 2 other people who received the same message.
All I can recommend is, do it! They have no choice but to release you given their coverage problems.

I had complained to OPTUS twice about terrible 3G speeds, and they basically tried the pre-emptive argument that my connection in my RESIDENTIAL area should be fine ...I responded that it wasnt and that i didnt take a contract (I always BYO anyway) to use a mobile device AT HOME! They pretty much said "I don't blame you for being fed up" and gave me the nod to call "retentions" to get out of the last 6 months of the contact. They didnt once argue that the 3G speeds in Sydney had been shocking over the past 6 months.. prety much agreed with me!

I have another 17 months on my contract with Vodafone and have tried walking in to the store and politely explain why I want to at least upgrade mobiles to one with better reception grabbing (oh and doesn't die after 5 hours of full charge and drops calls for no reason. oor the touch screen sometimes just deciding not to work) but all they said is I can buy a new phone on their contract and pay it off month by month. which adds up to be more expensive than getting a damn iPhone4. what should i try? Any advice would be greatly appreciated. and cheers in advance.

Currently trying to get out of a 24-month contract with optus, for my iPhone 4. Network stability has been getting steadily worse (call drop outs, spontaneously losing the network, missed SMS's)

After nearly 3 weeks of trying, they're now saying that they can only guarantee service coverage at your billing address..... but its a MOBILE CONTRACT, if I wanted a LANDLINE i would've bought one!

Anyone else in this situation??

I'm in the exact same situation! One way I have learnt to pick up 3G signal is by turning flight mode on and then off again. This seems to reset the signal for a short period of time. Annoying I know. I'm not sure how much longer I can put up with it for.

I've been with OPTUS for 6+ years and their mobile service/coverage in Melbourne seems to have slowly just gotten worse and worse. To the point that if I'm in a certain street in Northcote only 5km from Melbourne CBD I can not make a phone call unless I'm standing outside in the middle of the road and still I get drop-outs. I'm also sick of having to walk around the house with my phone held up above my head trying to find the "sweet-spot" to send a text message.

OPTUS' first response: "it can't be us, it must be you", first tried new SIM, then tried a different handset, eventually they sent out a truck to check the street. They got back to me and confirmed it was a "dead-zone". And the best they could offer me was letting me change my plan from the $59 to the $29, they wouldn't let me out of contract.

Any of my friends that visit with an OPTUS phone are doomed to share the same fate, especially apparent on iPhones.

Speedtest app can't even find closest server let alone test the speed here.

TTELECOMMUNICATIONS HORROR EXPERIENCE WITH OPTUS
I entered a second contract with Optus in Feb/March. I have a Blackberry Torch.
I am experiencing black spots, device problems and a terrible customer service. No calls or SMS get through to me in my office from Mon to Wed during business hours. I work part time in another job in a critical service area in which I can be contacted for assistance. So I rely on my phone email system to be connected. Unfortunately I cannot send emails from the mobile because of issues with the RIM email service from Blackberry. I wonder why on earth I have a mobile phone and why I am in a contract for ‘no service’.
Issue 2
Optus Customer Service young female harangued me over the phone insisting that a Nokia 8 phone was the best way to go on my second contract. After much coxing I accepted it only to return the Nokia 8 (before 10 days) because of issues with the phone. However, in those few days I went to hell and back with Optus. I was put through a number of customer service officers giving an assortment of excuses, lies. Most disturbing was the attempt from the customer service officers and even a team leader to coerce me to put up with a phone that was hopeless. Finally a kind soul in Optus saw the horror short history of back and forward complaints and changed my phone back to a Blackberry, this time a Blackberry Torch. I was also being charged (after 2 months) the monthly fee for the Nokia 8 device that I returned. I was credited by Optus for this latter mistake.
Issue 3
My contract stipulated no device charge upfront, rather a $10 device fee was to be applied on top of my monthly plan. All of a sudden a totally unexpected charge of $887 showed on my Amex statement (big mistake to give Optus access to deduct payments from my Amex). However, I had to lodge a complaint with the TIO because Optus would not reverse their wrong charge of $887 before 34 days. Amex came to the party and reversed the charge from my statement. But by mistake Amex reversed a charge that was my phone monthly usage. This ended in Optus cutting my service though I was up to date on my usage payments. On the 14 June, 20 11, Amex returned the previously reversed charge for my communications usage to Optus and on the 15 June they sent a letter to Optus explaining the error. Yesterday, 22 June Optus cut my service again because they did not receive the payment from Amex. And the vicious cycle back and forward arguments and distress started all over again. And, here I am, being up to date paying my services (I have my Amex statements to prove it) I have no service.

I was released from my Vodafone contract around December last year. Reception was okay, but 3G access was pathetic, voicemails would be delayed by days and data speeds were a crawl with data use impossible at some locations. I complained to the company who cited issues with my iPhone 3GS. After a few weeks and a TIO complaint Vodafone released me without further charge. I do not mind the company but their network just can't handle the customers they have!

I since moved to Telstra with an iPhone 4 but am having call drop outs. Telstra have acknowledged my (suburban) location as a blackspot but I'm not sure if I will bother trying to end the contract considering the other networks aren't any better!

Hi, just wondering if anyone knows of telco companies that are willing to pay out contracts with Optus.
I have been with Optus for 10 years now, pay insurance (mind you, I have never claimed on it). 2 months ago I was eligible for a free upgrade so I upgraded to the Nokia X3 (this didnt cost me anything as I am on a $49 cap and the phone isnt worth all that much).
After using the phone for a couple of weeks, I have decided that it isnt worth it (I am paying for internet and can't even use it as the screen is so small and you cant scroll through) and would like to upgrade to an iphone.I dont need the iphone 4, a 3 would be fine. However when speaking to Optus and saying that I would be willing to go up towards a $70 cap if they upgraded the phone, I was met with a no as I have just locked into the new contract. They have said to pay out the contract is $800 (the phone I have is worth a measely $200 odd). I can't get anywhere with them, even arguing the fact that I am willing to pay extra so over 24 months they will lose a considerable amount of money. Any suggestions on any phone operators that would be willing to pay out the contract (preferably Telstra as Optus reception whereever I have lived is always very poor and you cant make phone calls).

Cant believe so many people are having as much drama with there phones and telcos as I am. Do not sign up on a contract with Telstra they are no better. Have a farm in remote poor reception area. Had a "farm phone" but after two years kept getting worse reception. Walked into local testra shop and signed a contract for a phone supposed to be an upgrade farm phone on grounds if phone no reception could bring it back. Turns out wasnt the upgrade farm phone and doesnt work of course. 6 months later to cut a long story short, shop has the phone but Im still paying for it, wont let me out of contract, couldnt sell me the phone I was supposed to have. Had to buy a phone off ebay for my farm after doing my own research to see what would work. At least I can sell my phone on ebay if no good. Sick of trying to get out of contract and complaining. Ringing TIO tomorrow. GRRRRRRRRRRRRRRRRRRRRRRRRR.

It's good to know that i'm not the only one with an issue with Optus. Started my new contract with them in November and have been experiencing really bad reception. I contacted them and they acknowledge that i am in a poor signal area. The best they can offer me is a 3G Home Zone device and would use my broadband service to enhance the signal at home only. I'm not home half the time so it does me no good having this.
If i want to get out of the contract it's going to cost me $800. We have 3 mobile in my house hold that are on Optus and we need to change all. So Optus will make $2400. It isn't our fault that they are offering a crap service so i dont think we should be liable.

I have still yet to find any info on any of their Terms and Conditions stating that they only guarantee service coverage at your billing address.

If anyone else has any info on how i can get out of my contract or any other solutions please let me know.

Tommy, as this is an Aus site i dont think anyones gonna be able to help you. I lived in the UK myself my over a year and a couple of things i noticed that dont happen here is first up, "Unlimited Data" plans, that in fine print are ALWAYS limited to normally less than a gb, also, i was doing a canvassing job and one thing i noticed was that in low class areas id have full reception but little to no data throughput, and frequent call dropouts, walk into a higher class area, full reception, full data speeds, no phone dropouts. Thats what happens when poms put their heads in the sand and dont demand companies get held to the contracts they put out.

So is it possible to complain enough to Optus, and TCO and they'll perhaps let you out of the contract?
Signed up only 2 weeks ago, and the 3G is so slow. Half the time signal drops out, and I'm paying out $49 a month.
They say to cancel my contract, I have to dish out $785, but the phones only worth $450ish.
Theres no way I can sell the phone and get enough to pay off the contract... seriously want out. Telstra coverage was a lot more reliable and the internet was consistantly fastish.

Hey Emily, I thought they have a period of time when you first start a contract to be able to cancel particularly if the reception is bad. Did you find out if you were under it or did they just tell you how much to pay out?
I've got one month left on optus, and now they want to charge you $20 a month extra to have a phone with it (same with telstra too!!) I'm thinking of going onto telstra BYO and seeing if they have a newer iphone come out down the track - i have the iphone 3sg atm.
I hate telstra worst value for money, but I might be moving to WA where telstra is basically the only provider. I think if everyone who has an issue with service complains that maybe it will get through to them.
Also my partner is on three and they were meant to be merging with Vodafone, so that was the only reason he renewed, his house is a dead zone pretty much, we have endless fights as i cannot call him (exaggeration maybe :$), i think he'd have just under a year left. Anyway after reading this it seems three/Vodafone might help out with the contract. Good luck to everyone

I live in Bayswater and have the worst reception. Im with vodafone and complained. I got out of my 2 year contract with 18 months to go. No fees to get out just have to pay depreciation of iPhone which is $400. They tried to sting me another $80 to unlock it but put up a fuss saying you are making me leave as I cannot get reception. So they waived that too. Going with telstra. Very happy now. I was nice to vodafones cust service and they actually agreed with me that reception was poor in my area. I also checked where I worked and it was also a poor reception area which helped me cancel my contract.

I am with '3' and in my area I get no service, when my phone drops out I need to reboot it for any service to arise. I'm wanting to change providers to Telstra but not sure on how to go about it. I'm paying approximately $100 a month for an iPhone 4 so its a rip off in the beginning.. I've heard some people hand their phone's back to '3' so they can get out of their contract. does anyone know if this is true?

Can anyone recommend whether Vodafone or Optus is better for Melbourne metro areas for call quality & data speed (I live in St Kilda). I have been with Vodafone for 6 years and they're not great but it sounds like Optus are just as bad? Telstra are too expensive. Thx

Firstly, thank you for this thread and reassuring me that it's not just me. I am moving in with a friend who lives in a Vodafone and 3 black spot. Every time - over the past year - I've gone there, my phone has not been able to get any reception at all. It's horribly frustratating, and now that I'm moving in, I'm trying to get out of my plan. It is such a difficult process, as we speak I am on the phone, on hold, being put through to the fourth person. I have tried to explain that I get no reception at the address, and they are trying to convince me that it's just fine, and that I'll have reception with no issues! I get that they have to exolore all avenues, but treating me like an idiot is not O.K. Now they are telling me that the cancellation team is busy, and that they will get back to me. How difficult could this be!

It seems all the complaints are coming from the other Mobile providers.
Im currently using Telstra, and im a student. Reception is great nearly everywhere.
HOWEVER, Telstra is probably the MOST expensive provider here in Australia, i've been broke at many times just because i had to pay off my high Telstra bills.
$150 is my contract with internet and a useless $25 a month i pay for my unused landline.
BUT, i get charged at least $180 a month.. the highest bill was $650.. Crazy.

Just a warning. I REALLY want to switch to a cheaper provider, but go for telstra if you're willing to pay alot more for good service i guess. Just make sure its within your means unlike me.

Hi I am currently 5 months into a 24 month plan with Vodafone first 3 months were great bills were fine but the last 2 bills have dramitacially increased they keep saying its taxes etc and seem to add more on every month i am now trying to get out of the plan and go back to pay as you go any advise would be appreciated

I will never go to crazyjohns anymmore... they charged me twice on my august bills and triple times on my july bills..they admit their mistake , really made me sick. weak signals as well... cannot believe it... if they do know their system fault, why they cannot make an anouncement in the public? if I did not check my bank statement, I will never never know! pls be ware: donot go from directly from you card, check your bill first, then pay for it...

I've been in a contract for about 18 months with optus and my 3G internet constantly drops out...When I use my iphone as a modem on my computer and it drops out, i have to turn the phone off and on again to get the internet to work. The most frustrating thing is I can't find out whether it's an Optus issue or an Apple issue...they are both blaming each other and because I'm out of warranty apple won't even give me some tips over the phone without charging me. Does anyone know if the internet dropping out is a network issue or a phone issue?

Just got out of a $29 2yr contract with Vodafone (ex 3) because of terrible coverage....missed calls, text the next day etc. Took 5 phone calls and talking to the various levels, but got to 'retentions'and persisted. 30 days to port out with my number. I think they know they have problems and good on them for expanding the coverage, but not fast enough for this little black duck!

Problems with Vodafone - But happy with their solution...
I re-connected to Vodafone in January with a Samsung Galaxy (and while having difficulties with Samsung, that isn't Vodafone's problem) which in my area at Congo near Moruya, is virtually useless.
However I didn't cancel due to the likelihood of moving to another area where the reception is better.
Unfortunately, my relocation to Corryong in Vic is an area where Vodafone has NO reception.
They were cool and offered me a few worthwhile solutions. I choose to have my plan suspended without charge for a few months to allow for the possibility that my work may take me to an area of reception.
If that does not eventuate, Vodafone have agreed to cancel my contract without penalty – pretty decent I think.

First of all dont let people think that the ombudsman is there to help them get out of contracts. They are there as a front for these providers. I do work in the industry there are some ways to get out of your contract.1. You pay your way out. 2. You upgrade your plan. 3. Move services away from the provider that are not under contract.4. Read the contract before signing it.5. If the service does not work.
I have had a 10 month battle with telstra because they could not provide the service they promised and yes I did get out of contract but it was a long hard battle. Patience and respect gets you there in the long run...

Wrong - I am having issues with my handset which Optus refuse to replace as it hasn't been sent away enough times yet. I have very poor reception when my Samsung Galaxy is working. I've asked them if they will waive or reduce the fees on the contract if I upgrade to an iphone - only because I've had so many issues with my Galaxy - and I'm still told no. I have done 12 months of my contract in 4 days and they still want to charge me $800, even to UPGRADE. I remember Telstra used to ring me to try and get me to change and for about 12 years I have been a loyal customer of Optus. This means nothing to them. Patience and respect? Don't even get me started on that......

Thankfully I got out of my Vodafail contract 18mths early. It did take two months of phone calls to log complaints and try solutions offered (internet on my HTC Desire HD handset was frequently not available), but eventually have been freed. Now with Telstra and so far so good.

I want to get out of my VODAFONE $79 contract. VODAFONE are terrible. Do they spend all there money on sponsorship? They are just as bad as THREE. I have five months left on my 24 month contract, missing constant calls, even had to buy a pre paid phone with TELSTRA for coverage out of sydney. What to do go with TELSTRA and pay higher but guaranteed quality or cheap out and go threw a head ache?

Utterly disappointed with not only 3's reception but also their customer service. I've spoken to 9 different people, lodged a complaint and spent numerous hours on hold. I've even had to call THEM back when they agreed to call ME back. I'm frustrated at dropped calls or no reception and their unwillingness to resolve the issue. Pending the results of the 'investigation' they have supposedly launched into the areas where I've had reception issues, I intend to go to the TIO. I'm fed up, and will not be signing a contract with any service provider for 24 months again.

I was just release WITHOUT fees from an Unlimited Calls, 24 Month Telstra contract (After 3 months).

No service after I moved, so calls to support and after trying a 'bumper case' and then a 'Blue-Tick' phone (BLackberry Touch and others are 'bluetick' enabled already - Not iPhone 4) and no success I was told "If Telstra signal is poor, then the OTHER providers will be just as bad, so turn-off 3G and try to live with it".

I lodged a formal complaint, and explained that Optus has the HOMEZONE (3G Booster that uses Internet connection) and therefore they HAVE a solution that Telstra do NOT (In my new home).

Telstra allowed early contract termination, no FEES!, and purchase the (near new) iPhone 4 for $394.... a GREAT deal.

Now, I am on Optus, with a new iPhone 4S, and the Homezone gives me FULL 3G bars... My daughter is also on the Homezone at home.

The best part, this now costs me $99 for unlimited calls (1-2 GB per month on broadband when I have a 100GB limit is nothing) which is 2/3 or Telstra as well.

When I'm OUT of the house and about, I get a sililar (crappy) service from either Telstra or Optusnet.

I have been with optus on a 24 month contract, but have only been on that contract for 5 months, and as I can see I'm not the only one having really bad reception on my iPhone 4! I am getting so frustrated! And while I am typing it says SOS only.. That's all it ever says, and to send a text I have to hold the phone over my head to get reception, but apparently it's really hard to get out of a contract so I don't know what to do! Iv had my sim replaced, I went to Optus and got my phone replaced with another iPhone 4, but it's obviously Optus not apple! Anyone got any ideas what I should do?

my daughters both had contracts with vodaphone - 24 mths- we had no recption at all- contacted vodaphone who apologised and gave us masses of free calls etc but was of no use cos had nil reception-contacted ombudsman - vodaphone were straight on to it and cancelled the contratcs no charges and sent a pre post bag to collect phones!! With Optus and sp fabulous!!

Actually I had many problems with telstra! At one stage I was actually told that if I didn't like the customer service I could just F off to vodafone...yes he actually said the F word...he refused to go into my account as he said he couldn't be bothered. So anyone who think that telstra are angels and provide good service...think again...their customer service is atrocious.

Im with Optus and have definitely had my arguments with them even to the TIO about them for f##### up my contract.. but they have excellent covereage and reception and a fair price. I tried telstra on mobile, awesome upload speeds, but in my tests the download speeds were almost identical.

Service with tlestra service is better (as in when you have to call up) but thats it.. If your older and need it go for it

I was with Voda, with 6 months left. After constant arguing with our local Australians (in India) to no avail, i emailed the CEO and soon was released from contract.

Switching over to Telstra was the best thing i have ever done. And at least some of the company is owned by Australians. A little more $$ for a LOT more service. No drop outs, phantom missed calles etc. No stress. We all need to back our Aussie Companies more and stop settling for cheaper inferior foreign products and services. It would be good to keep some jobs in Australia. Think about it?

If anyone wants the CEO's email address for Voda, you need to first know his name, add a dot in the middle. Then the rest i'm sure you could work out. As a bonus, i got to speak to an Australian in Tazzy!

I once got out of a contract with 3 about 1 1/2 yrs ago, and at the time, went to Crazy John's.

Whilst I'm still not getting coverage at home (That's a different story), I suggest to people that are thinking of moving to a different carrier because of poor coverage, purchase a cheap pre-paid SIM.

As long as your mobile isn't locked to the other carrier, you'll soon be able to test if the other carrier is right for you or not.

I work for telstra as a supervisor and i gotta say when you sign a contract you need to understand it is for 24months. The ETCS are not just for the mobile but to cover the cost of the lost revenue for giving you more calls at a cheaper rate. If you notice pre paid calls cost about double the amount as post paid. So When you cancel your contract within 12 months the company has lost money as they have been charging you post paid rates and not getting the time frame of guaranteed payments for the 24month term. You are a douche if you call up expecting to break your contract beacause you cannot honour your word and sure you can call up threaten TIO action but in the end your just screwing over every other customer of that company. As lost revenue means less infastructure upgrades and less maintenance of the network, but oh wait "i wanna break my contract that i agreed too and my signal is crap and america has 4g a year ago but the magical ombussmen will fix everything" Your screwing yourselves over and every australian.. Sure save some money by making less calls or going on a lower of higher plan. But you screw over the company and your service will just get even more crap.

Hi i hope someone can help me with this i was with crazy johns up to last year had no coverage where i lived after a hell of a lot of phone calls and visits to the store they wouldnt let me out of the contract so i had enough and told them i was going to cancel the direct debet and stop paying them and i did so they sent a collector after me and told me if i didnt pay. it would go on record and effect my credit rating so i agreed to pay them so much a month witch i have been is it two late to complain to the tio

I am currently with Telstra for my internet, purely because they are reliable for the service they provide me with. Vodafone, after taking over 3 mobile and its plans, appears to be conspiring to make the 3 customers to switch over to their network...As long as I was with 3 I had no reception issues but for rare coverage problem when travelling to far western regional NSW. Now, with 3 under vodofone network, coverage, poor reception, call drop outs is the order of the day...probably they are trying to make customers with the 3 mobile brand name to switch over as vodafone customers by hook or crook...any 'class action' possible against such phone companies? Or, would public action (a la Occupy Wall Street - OWS campaign)make them change their behaviour?

Two years ago I decided to sign up on a plan as i would be needing a phone being an assistant manager. I went to Optus and asked them to sign me up and to ensure I get service at my house. Going ahead and signing the contract I believed every word they informed me regarding my plan itself and the reception that I will have at home. I got home and it was only one bar out of five bars that it would only have reception. I then had to deal with it until I went to another Optus store and complained about my reception. They turned me around some many times I lost count. They told me it would have been the phone itself so I then went to Chermside to the Apple store and got the Iphone replaced two in three months. I went to another Optus store roughly three months ago and the lady informed me that maybe if i upgraded to a Samsung phone it will prevent the reception from dropping out. I've had the phone for three months and it's doing the same thing! Not only is the phone having lack of reception but also paying for a phone that I cant hardly use at home as it drops my calls whilst im on the phone.

Will the TIO cancel my contract that im currently on?

Lots of issues with reception etc. I would like to know how it sits when on a contract for 24mths and your product dies 14 months into it and you ask if you can upgrade it and are denied, despite being a long term customer. So breaking a contract my last option, however the very unhelpful customer service reps merely read their script rather providing good old honest service based on loyalty. Perhaps the TIO is the way to go on this but one would hope that it was a no brainer for a telco to honour a honest client...

Vodafone new network is rolling out evry where.. we hav a 'x' mas offer in vodafone.. 49$ plan 700 worth of talk time and iphone 4s for free.. this is jus for'x'mas.. so hurry up.... there ws a problm with vodafone network... i do belv... but now we use 850MHz device for our network which is same like telstra...
and also we spent 1Billion dollars for the service.

Ok, so i got my daughter a smart phone for her birthday, we pay $30.00 a month for this phone, she has probably had it for about 3 months she has just recently decided she wants a different smart phone that also cost $30.00 a month. So can we just get the phone (on ebay) and take it in and have the new phone wihtout getting charged anything? Oh and the thing is we have signed a 2 year contract for the smart phone, so we have to pay $30.00 a month, but if you find a differnet phone that cost the same amount each month can you just get the phone switched? AllConnect Communications Pty Ltd - Sydney based firm are the worst I have come across. You make an order for a mobile, it arrives 12 weeks later, you pay for a phone plan like a $79 plan and they overcharge you $300 - $1000 month. You complain and they threaten to destroy youre credit rating rather than follow the various steps involved in any disagreement or argument. It is evident that they dont have any stock which results in customers waiting 12 weeks for a mobile phone to arrive after ordering it. They dont have any money to purchase stock which indicates this company is financially bankrupt. Its owner operators are morally bankrupt as they try to brand their company as a champion of social justice but in realty they are only a business that needs to make profit.

I too am in a similar situation with an admitted blackspot at my new home address on my Optus iPhone 4. After sitting on the phone to them for 2 hours being transfered around from one department to another I finally got them to agree that I should be let out of my 24 month contract. They pushed to give me the the Home Zone but as I dont have an internet connection this was not a viable option PLUS i would prefer to be with Teltra where I know reception is fine. The catch however is if I wanted to keep the phone they would cut the cancelation fees by 50% or I would pay no cancelation if I returned my phone undamaged. The problem is my phone is cracked on the back which doesnt affect its ability to work but they are not willing to accept it if it has ANY small damage - SIGH!

I was on optus once and i got no 3g reception inside of the house and i phoned them and told them i had to go to the footpath or on the roof of the house and i phoned them quite a few times and i get the reps employee number and wrote it down and i was in the middle of a 24 month contract and i phoned the tio and spoke to the same rep a few times and i had 2 mobile numbers the second number was a modem number the rep from optus phoned me and said i can port the mobile number and i ported both of my numbers

I moved and had no reception with Optus, I had little to no reception at my last address also, but just suffered the coverage. Both spots were black spots.I have been run around for 1 month in trying to get my service disconnected, they have charged me a cancellation fee of $560 plus said I have to pay $180 cancellation on my wireless to which I never signed into a contract, I call them and explain the run and they give me the run around say they will call back and never do. They are so dodgy, and I feel disappointed as a consumer, as you trust they will do the right thing. But what they try to do is get you to agree to pay the cancellation fee and then you have to suck it up. so today I contacted the Telepone Industry Ombudsman and put in a complaint, now sitting at stage 1, they will contact Optus and ask them to resolve this, he said in the case of a black spot they SHOULD waver the fee and that it is not right what they are doing. I am sure I am not alone. So if you are like me, don't agree to a cancellation fee, tell them in the contract it states that if you are in a black spot or poor reception area, you have the right to cancel, I had til May left and $75 dollars equipment fee, that charge is just ridiculous and so too is Optus, they are not honest.

Im on the second month of my new Vodafone contract with the iPhone4 I have experienced everything except "good" service. I have dropped calls, extremely slow Internet(5mins to update a page) ,and the phone also has problems like freezing and sticky buttons! I have been trying to handle this with Vodafone for the past week but I have just recieved a response that they aren't able to do anything as the problems did not start at the primary address where I activated my phone! WHY?? I really want out of my contract with them! They are advertising now with the Vodafone coverage gaurantee, which is completely rubbish! If I am not removed from the contract soon I am considering contacting the TIO to have it resolved. Also, is anyone else having the same problems as me!

Are you aware that these CUSTOMER SERVICE GUARENTEES not not cover mobile phones...which seem to be the majority of peoples complaints on here??? I quote:
"WHAT IS NOT COVERED?
The CSG Standard does not apply to data products (eg. Telstra's Digital Data Services), customer premises equipment, customer cabling, payphones, and sophisticated business-oriented services, such as Telstra's Centel, SiteLines, corporate virtual private network and similar services. It also does not apply to mobile or satellite services, unless these are used to deliver Universal Service Obligation (USO) telephone services."

You also stated that you work for Telsra? Well now I understand why so many people on here are upset! Like you, other Telstra employees are providing people the wrong information :)

I finally made the move and terminated my contract with Optus (6 months left) and moved to Amaysim ($39 Unlimited Plan).
At first I went to Parramatta Optus shop and asked about upgrading my monthly plan to a higher one, because my previous pill was $270+ due to some called i made towards the end of the month, the young lady there said the she can't help me "now" because this takes time, and she has to service another customer (who came after me and seems to be her friend),I objected to that and said I was there first, otherwise why did she speak to me first! She then asked one of her colleagues who rudely answers that they don't do upgrades at the shop and I have to call customer service, without even looking at me.
At that point I decided to leave Optus no matter what.
I called Optus Customer "lack of" Service, asking about the a) bad signal and almost-not-there internet reception and b) payment options and I now have to pay $270 and if they can do anything about it. They totally ignored the signal/internet issues and only focused on getting my on a higher plan (pay them more money) to avoid going above my monthly plan. I confirmed with the rep. that I only need to pay $296 termination fees.
Today I get my bill with more than $440 worth of termination fees, late fees and mobile usage that is not covered by the plan due to termination (They never mentioned this before)

I’m sure that there are a lot of happy Optus customers out there, but one day they will be adding to this post expressing their disappointment and frustration with Optus.
I’ve never suffered from high blood pressure, diabetes or ulcer before, but thanks to Optus, and after calling their so called customer service again today I guess I have them all.

I have been in a contract for 12 months now and I have just recently moved to a rural town where the Optus reception here is terrible. I have a friend who was able to get out of their contract early without having to pay as long as they sent their phone back in working condition, what I want to know is what do they see as working condition? If there is water damage inside the phone but everything is still working would they make me pay the cancellation fee? I have been putting off calling Optus and trying to cancelling my contract because I don't know if they are going to let me cancel and also I hate that the operaters are so hard to understand. Any advice?

What people don't realise is that when you sign up for a service provider you are entitled to have a service provided. If the service provider does not provide a service then they are in violation of the contract. You don't need to break the contract as they have already broken it. If the provider has broken the contract then you are no longer under obligation to pay any penalties or fees as stated by the contract. If they try to charge you explain it to them and if that doesn't work go straight to the ombudsman. Know your rights and exercise them!

Why don't people go prepaid? I buy my phones outright from websites including google play store, and Unique mobiles. I buy a prepaid sim from Amaysim I have good reception and pay extra for data usage and I'm not locked into any contract. I can chop and change companies as much as I like. In the end I have the choice to keep my phone as long as I want to, or sell it and buy the latest phone with the fastest features - if I choose.

Going into a contract is wrought with problems and is definitely not for me!

Hello to every one out here, am here to share the unexpected miracle that
