IceTV High Court decision to be handed down tomorrow morning

Third-party program guide provider to have appeal against Channel Nine decided

The High Court of Australia's decision regarding the legality of the reproduction of Channel Nine's television programming guide by third-party provider IceTV will be handed down tomorrow morning at 10:15 EST.

The decision regards the company's reproduction of electronic programming guide content. This case was originally brought against IceTV by the Nine Network in May 2006, while IceTV was attempting to raise capital through a public float. This float had to be cancelled due to the difficulty of raising sufficient funds while the company was in litigation, according to IceTV.

The original case against IceTV was successfully defended and Channel Nine was ordered to pay the company's legal costs after eight months of deliberation in the Federal Court.

The Nine Network appealed the decision in August 2007, and in February 2008 the original decision was overturned. This most recent appeal by IceTV aims to allow the provider to continue its original method of compiling and reproducing guide material.

The decision will be handed down at 10:15am in Canberra by the High Court of Australia.
